The average price of propecia at CVS has yet to improve beyond what it was in the drug’s patent-protected monopoly, but that figure may be starting to change, a consumer advocacy group said Wednesday.

In the first of three generics-imposed “free trial” costs, CVS is expected to charge an average of $4.50 for a 1-milligram tablet of finasteride, the group’s top-tier product.

CVS’s price has been on the rise in recent months, with analysts suggesting it will spend an additional $1.7 million to $1.9 million annually on finasteride, a move that would be similar to an acquisition by Merck & Co.

“We believe that this represents an important milestone in the battle against hair loss,” said Susan K. Stein, a consumer advocacy group’s executive director.

The group filed the case against CVS last week in San Francisco, where it is expected to take up the $4.50 figure charged by finasteride for generic Propecia.

Under a court-imposed licensing agreement, CVS will have the exclusive right to market the generic for as long as 1997 and for up to 36 months in some cases when a product is no longer available. As a result, it will have a market share that’s likely to be much larger than the monopoly market that the drug industry is seeking to protect from competition.

Analysts said the average price of finasteride at CVS — the generic that Merck already sold — will remain the same, although analysts say the deal will offer a cheaper alternative.

The group says the average price for a 1-milligram tablet of finasteride is $3.96, or 15 cents above the median price of $14.74 at $57.98, which is five times the national average price of $29.48.

“This is not a bargain-and-break deal,” said Michael Cohen, senior analyst for KPMG’s research and development division.

CVS’s patent for finasteride, which is still set to expire, will expire in October 2017. It will be taken from the patent’s last application.

The group said its case is “not a case in which a generic drugmaker had an easy victory in a patent case,” though it did not respond to a request for comment. The company declined to disclose its figures.

The company has a history of successful sales of Propecia and has been a major player in the hair loss market. CVS has already received more than $800 million in press attention for its Propecia trial, with more than $600 million for finasteride.

In 1997, Propecia was the first drug to be approved for hair loss, and in 2002, Merck patented Propecia for the treatment of enlarged prostates, also known as male pattern hair loss.

By 2004, Merck’s Propecia patent ran out and generic competition was fierce. Generic versions of Propecia saw a run in the United States, and a generic version was eventually approved in Canada.

A CVS spokesperson said that the company is committed to the product’s continued growth and the product’s strong safety profile.

“We have always been patient and patient- contributor. That’s why we are proud of this case,” said Greg Beukes, CVS’s chief medical officer.

CVS also cited the Propecia “highlight the importance of a strong and sustained product.”

Merck has already lost more than a dozen generic Propecia patent cases to competition in the United States. It faces competition from generic competition in the European Union in June, but has yet to win a single case, and has already lost at least two.

But the drugmaker said it is working with CVS to bring new generics to market, and that the company is prepared to dispose of the patents if any.

“I believe that the case is strong,” Stein said.

In January, CVS will pay a $4.50 co-pay to its generic partner for the first time, according to a CVS spokesman.
